1 - ACCEPTANCE OF THESE TERMS OF SALE

By confirming an order you agree to accept our general terms and conditions governed by French Law. We reserve the right to change them without notice, please read them regularly by consulting our homepage www.winebeersupermarket.com before confirming an order.

2 - OFFERS

All products are offered subject to availabilty. If a product is unavailable after an order is placed, and you have not opted for substitutions at the time of ordering, then we will contact you to either arrange a replacement or offer a refund.

3 - PRICES

Prices are shown in Euros and include all local taxes and duties.

Prices are the same whether for collection from either our Roscoff or Cherbourg stores, or on the website www.winebeersupermarket.com

Delivery charges are not included. They must be paid by the customer and are calculated based on the number of bottles ordered. Full details are available by clicking on ‘Terms of Delivery’

4 - ORDERS

You will be delivered to the delivery address specified at the time you place your order. We are not liable whatsoever for any products delivered to an incorrectly given address. You may receive communications from our courrier during the delivery process.

5 - PAYMENT

Prior to completing the order payment can be made through our secure online banking portal. All details are handled directly by Crédit Mutuel and are totally independent of our website. We never stock or keep your personal information.

Payment can also be made by card over the phone. We will need the long card number, expiry date and 3 digit code (CVC) on the back, once approved all details will be immediately removed. In case of repeat orders we will request your details on each occasion.

6 - DELIVERY

We will be dispatch your order to the delivery address given at the time you place your order. We are not liable whatsoever for any products delivered to an address you have incorrectly provided us with. You may receive communications from our courier during the delivery process. Delivery charges are to be paid by the customer based on the number of bottles ordered and method of transport. We may offer several options but the final cost will be confirmed before the the order is completed.

Delivery takes between 15-21 days whatever method of transport is selected. This includes preparation time, collection from our warehouse and delivery to the customer by the delivery company we choose.

WBS guarantees to make every effort to deliver orders as quickly as possible and to track the order at all stages. However we will not be held responsible for any delay caused by the transporter which is completely out of our control.

WBS orders can be collected from either of our shops in Roscoff, Finistère (29) or Cherbourg-en-Cotentin - La Glacerie, Manche (50) without incurring further charges. All orders placed through our website www.winebeersupermarket.com can be collected on presentation of the invoice and proof of identity.

7 - ORDER RECEPTION

Initial inspection – carefully check all packages in the presence of the driver.

The customer must inspect the contents and state of the order before signing the delivery note. In case of any anomaly such as an incorrect product or damage, it is essential this is clearly noted on the delivery note including the number of broken or damaged bottles as well as how many are accepted. You are within your rights to refuse the goods in these circumstances but it is imperative you mark clearly on the delivery note the reason why.

Without a clear and precise explanation in writing for the reason for your refusal we cannot accept responsibility for any subsequent claim.

Damaged Goods: to be clearly marked on the delivery note

If any ordered products are broken and this has been clearly marked on the delivery note, WBS will offer to resend the order. If the same wines are out of stock WBS will either offer alternatives of a similar or better quality unless terms of sale have changed, or a full refund.

8 - CANCELLATION PERIOD

The customer can return his or her order within 7 working days for a no quibble, hassle free refund and no further penalties will apply, with the exception of return carriage charges for which WBS will not be liable. Please let us know in writing by either letter, email or fax of your intention to return goods before sending them.  All returns to be addressed to WBS, Keravel, 29680 ROSCOFF

Consequences

WBS will refund the customer in full for returned goods within a maximum 2 weeks, with the exception of return carriage costs which are at the customers expense. All damaged, opened or consumed goods will neither be accepted nor refunded, this to include damage to packaging and labels. The refund will be credited either to your card through our secure online banking system or otherwise sent directly by cheque.

9 - LEGAL NOTICE

Legal compliance, consent and contractual obligations

In accordance with the French law « Computing and freedom of information » No 78 dated 6th January 1978 you have the right to access and amend your details on file at any time by sending a letter to the following address :

Minimum Legal Age

In accordance with article L.3342-1 of the public health code the sale of alcohol to minors under 18 years of age is forbidden. All completed orders are on the basis the purchaser is at least 18 years old on the date it is submitted, WBS accepts no further responsability if this has not been strictly adhered to.
